terms and conditions

This agreement is between you (henceforth referred to as “You” or “the Client”) and
TLVMassages.com (henceforth referred to as “ TLVM” or simply “The Services”). By booking
and attending a treatment with The Services, it is taken as proof that the client has read,
understood and agreed to the Terms and Conditions.

 

1. Definitions:

The following words shall have the following meanings
1.1 ‘The Client' means the person and/or company named on the online booking form for
whom the Services have been requested.
1.2 'Agreed Hours’ means that massage therapist/s will be available for the hours as
requested on the clients completed online booking form.
1.3 ‘Individual’ means the individual guest/employee of the Client attending the event who
has requested a Treatment.
1.4 ‘Treatment’ means the Treatment requested on the clients completed online booking
form performed as described on our website.
1.5 ‘Massage Therapist’ means the individual therapist who attends the Premises for the
purpose of performing the Treatment.
1.6 ‘Premises’ means the location address as it appears on the website.
1.7 ‘The Services’ means the services set out in Clause 2 of this agreement, also referred to
as TLVM.

 

2. The Services:

2.1. TLVM shall provide qualified and insured Massage Therapists to the Client at the
Premises for the Agreed Hours. All therapists are covered for Professional Indemnity and
Public Liability insurance. Copies of the therapist’s certificates will be sent to the Client on
request.
2.2. TLVM shall instruct the Therapist to provide Treatments as requested by the Client and
attend to the requirements of each Individual who requires a Treatment exercising proper
professional skill and diligence in the rendering of the Treatment
2.3. The Massage Therapist reserves the right not to provide a Treatment for any Individual
they deem unfit to receive such Treatment.

 

3. TLVM Obligations:

3.1. TLVM must provide a suitable area for the Treatment to take place and a contact person
for TLVM to liaise with.
3.2. All Individuals receiving a Treatment must sign a medical consent form prior to every
treatment.
3.3. TLVM is responsible for delivering the Treatment schedule to the Therapist before the
start of the Agreed hours if applicable.
3.4. TLVM will explain to each Individual the nature and extent of the Treatment.

 

4. Payment by the Client for bookings through this website:

4.1. The agreed fee for the Services is as shown online.
4.2. Payments can be made online at the time of booking via PayPal, Credit Card or accepted
in cash in person at the set appointment. The Client will be directed via the website booking
form to our secure payment facility. Only 10% deposit of the full payment will be charged at
the time of website booking and the other 90% will be paid in person in cash at the
appointment time and provided with all the necessary receipts. Bookings are not confirmed
until the initial payment deposit is made.
4.3. Any changes to the Agreed Hours or Treatments requested once 10% of the payment
has been made and the booking confirmation has been received may affect the agreed fee.
Refunds will be considered on a case by case basis.
4.4. A surcharge will be incurred for workplace bookings that take place outside of set
business hours. It will be applied as an additional charge once the booking has been paid for
and confirmed.
4.5 There is no VAT applicable to these costs.

 

5. Cancellations and changes:

5.1. Once a booking has been confirmed, cancellations will incur the following charges: 10%
deposit fee will not be returned. No other cancellation fees apply.
5.1.1. Cancellations made 24 working hours’ notice until the appointment time or more -
10% of the fee will be taken (the 10% deposit required upon booking).
5.2. Changes to the Agreed Hours may be made by giving 24 hours notice before the set
appointment.
5.3. The services reserves the right to cancel the provision of the Services without notice in
case of the illness of a Massage Therapist or other circumstances beyond its control. TLVM
shall make reasonable attempts not to cancel the Services but the Client acknowledges that
it may not be possible for an alternative Massage Therapist to attend the Premises. In this
circumstance the client will be offered an alternative day or a full refund (of the 10% initial
deposit) will be issued.

 

6. Termination:

This Agreement will terminate automatically if either party shall be in breach of any of its
obligations under this Agreement or if either party shall have a receiver, administrative
receiver, or administrator appointed, or shall enter compulsory or voluntary liquidation.

7. Liability & Insurance:

7.1. The Client acknowledges that the Massage Therapist is an independent contractor and
not an employee of TLVM and that any liability as to the provision of a Treatment is between
an Individual and the Massage Therapist.

 

8. Medical History:

8.1 The client shall provide TLVM with all relevant health and medical information to the
best of their knowledge, in full and agree to it being kept privately, confidentially and in the
understanding that it shall never be passed onto or read by any third parties. All Individuals
receiving a Treatment must sign a medical consent form prior to every treatment.
8.2 The client understands that massage and other similar body-work treatments are
therapeutic in nature and are NOT a substitute for medical examination or medical care.
The client should honor all existing and future medical practitioner appointments. Under no
circumstances should the client stop any course of medication or treatment as prescribed by
a local GP or other medical practitioner without informing TLVM. The client should update
TLVM with information in regard to any changes to any ongoing medical treatments as these
changes may affect the therapy treatments in some way.
8.3 The client understand that any treatments from TLVM should not be used in place of
conventional medical care. The client should always consult a GP or a healthcare
professional for medical attention and advice. TLVM does not employ qualified general
medical practitioners and any views or opinions expressed on topics outside of her
acknowledged training should be treated purely as that and must not be acted upon before
consulting your own GP or healthcare professional.
8.4 By following these simple guidelines it will eliminate the possibility of any potential
situation arising where The Services massage therapists at TLVM have not been fully
informed about the client’s medical history.
8.5 The Massage Therapist reserves the right not to provide a Treatment for any Individual
they deem unfit to receive such Treatment.

 
By booking and attending a treatment with The Services, it is taken as proof that the client
has read, understood and agreed to the Terms and Conditions.
